On July 19, 2023, the U.S district court for the eastern district of TN issued a ruling with significant impact on 8(a) program sellers and buyers. The court decided that the Small Business Administration could not presume social disadvantage based on membership in socially disadvantaged categories – owner(s) of small, disadvantaged businesses must now demonstrate their social and economic disadvantage with a narrative for SBA approval. 

As the end of the fiscal year looms, the changes have significant impact for businesses and federal buyers and primes scramble to understand their ability to contract or receive contracts under the 8(a) program.
