On July 19, 2023, the U.S district court for the eastern district of TN issued a ruling with significant impact on 8(a) program sellers and buyers. The court decided that the Small Business Administration could not presume social disadvantage based on membership in socially disadvantaged categories – owner(s) of small, disadvantaged businesses must now demonstrate their social and economic disadvantage with a narrative for SBA approval.
