Contracting Officers are required to identify and evaluate potential organizational conflicts of interest (OCIs) as early in the acquisition process as possible. The FAR provides that an OCI exists when a person or organization is unable or potentially unable to render impartial advice to the government or the person’s objectivity in performing the contract work might be impaired or the person or organization has an unfair competitive advantage. With more and more mergers and acquisitions occurring in the federal market space, more and more potential OCI issues will be arising. This session will cover new case law on OCIs, the contracting officer’s duties and the contractor’s obligations of mitigation.
